Why is Imran Khan’s trial happening in jail?

The tradition attributed to Maulana Abu Al-Kalam Azad states, “The greatest injustices in history have occurred within the halls of justice.” In reference to this quote, the injustices of the Pakistani judiciary have persistently cast shadows over the spirit and body of the nation.

Following the controversial verdict in the case of Maulvi Tameezuddin, notorious during Justice Munir’s era, the Bhutto execution case affirmed the truth that if anger, bias, envy, and greed find their way into the corridors of power, they can lead to any extent of injustice.

It is well-known that Justice Maulvi Mushtaq had personal animosity towards Bhutto. The appointment of Islam Riaz Hussain as Chief Justice became a point of contention, and the world witnessed an attack on Maulvi Mushtaq’s funeral after the verdict. The mourners left the deceased and fled, leaving Maulvi Sahib’s body alone.

Our tradition dictates that actions are held accountable in this world as well. Perhaps, a similar fate befell Maulvi Mushtaq.

Justice Anwar-ul-Haq and his fellow judges, who mostly disagreed with Bhutto, faced fear and pressure. Hence, a decision was made against Bhutto.

Justice Anwar-ul-Haq also had to bear the consequences of this decision. Defeated in the global court of justice elections, he faced loneliness and departed from this world.

Currently, Zulfikar Ali Bhutto’s case has reopened. It remains to be seen how today’s judiciary rectifies the dark history of judicial murder.

It is not only the Bhutto case; it has been proven that decisions against Benazir Bhutto were also influenced by the pressure of Saif-ur-Rehman and Nawaz Sharif. This is the reason why Justice Qayyum and Justice Rashed Aziz had to resign. It is astonishing to note that Justice Qayyum pronounced the verdict against Benazir and later, when he became the Attorney General during Musharraf’s regime, he wrote a letter to Swiss authorities to end the cases against Benazir Bhutto and Zardari.

Recently, another injustice against Nawaz Sharif is under discussion. In a leaked audio, Nawaz Sharif mentioned the name of Justice Sheikh Azmat Saeed, a sitting judge, alleging that he recommended the promotion of a woman to grade 19. When the promotion did not materialize, Nawaz Sharif claimed that Justice Saeed suggested a vacant cottage in Adiala Jail for the Prime Minister. Although the Prime Minister’s Chief Justice wrote a protest letter, it received no response.

I possess a credible document that contains remarks by the same judge’s brother, Hamza Shahbaz Sharif, during the period when this judge served in the NAB. The document indicates that the Sharif family not only had enmity towards this judge but also presents evidence of their systematic opposition. When there was hatred and bias against the Sharif family, the decision was bound to be against Nawaz Sharif.

During the same period when the Prime Minister Nawaz Sharif was facing a trial, a secret meeting took place between a league minister and a judge of the Supreme Court. The minister claimed that there was immense pressure to make Nawaz Sharif resign. Interestingly, this desire was the same as expressed by General Zia-ul-Haq through the agency of Riaz Ahmed to Nawaz Sharif. It seems ISI chief General Zia-ul-Islam and this judge had a similar stance. There was also information that a film of a lord enjoying alcohol was in possession of an organization, and they were blackmailing him with it.

Another lord who was part of the bench in the Supreme Court was a legal advisor to a very large plaza in Islamabad. When his case came up in the Supreme Court, he sat on the bench himself, which was a clear clash of interest and against the demands of justice. The internal stories of the remaining lords who passed judgment against Nawaz Sharif are also safely stored in the intelligence bureau and with the Sharif family.
