The ACT Supreme Court has found that Walter Sofronoff’s “private and confidential” text messages with a columnist for The Australian gave rise to a “reasonable apprehension of bias” against former senior prosecutor Shane Drumgold.

But the majority of the Sofronoff inquiry’s damaging findings against barrister Mr Drumgold – who was in charge of prosecuting Bruce Lehrman – have been upheld.

In a written judgment published on Monday afternoon, Justice Stephen Kaye likened the journalist and the judge to “fellow passengers”.
